BERNARDINI, BELTRANDI, FARINA COSCIONI, MECACCI, MAURIZIO TURCO e ZAMPARUTTI. - Al Ministro della giustizia, al Ministro delle infrastrutture e dei
trasporti, al Ministro per la pubblica amministrazione e l'innovazione. - Per sapere - premesso che:
in relazione alla grave situazione di sovraffollamento delle carceri, il Consiglio dei ministri del 13 gennaio 2010 ha deliberato un piano straordinario penitenziario dichiarando lo stato di emergenza nazionale fino al 31 dicembre 2010 (decreto del Presidente del Consiglio dei ministri 13 gennaio 2010, pubblicato nella Gazzetta Ufficiale n. 23 del 29 gennaio 2010); term was extended by Decree of the Presidency of the Council of Ministers on 12 January 2011;
March 19, 2010 was issued the order of the President of the Council of Ministers, which has dictated new urgent measures civil protection aimed at tackling the situation of emergency caused by the prison overcrowding. The measure provides, inter alia, that the head of the prison administration, appointed commissioner to delegate "the prison emergency" within 30 days should provide an appropriate action plan, indicating the timing and modalities of implementation. The ordinance establishing a steering committee chaired by the Minister of Justice, whose responsibility approval of the plan and the supervision on the action taken by the Commissioner;
that order provides for: a) Article 1, paragraph 3, for the realization of the actions of his direct jurisdiction, the commissioner of the department director uses Prisons of the Ministry of Justice and requires all necessary cooperation to the peripheral administrations of the State and the local government authorities and non-territorial, b) in Article 1, paragraph 4, that the Deputy Commissioner shall appoint one or more of the actuators to be assisted in implementing the provisions of the plan, to carry extraordinary prison and entrusted to the same specific areas of intervention; c) Article 1, paragraph 5, the Deputy Commissioner, heard the head of the civil protection department of the Presidency of the Council of Ministers, with a provision to determine the compensation to be paid to implementing parties referred to in paragraph 4, with charges load of the resources referred to in article 3 of the Order, that in relation to the professional and duties as assigned; d) Article 1, paragraph 6, the supervisory action of the Commissioner delegated responsibility to a committee guidance and control chaired by the Minister of Justice (or his nominee) and comprising the Minister for Infrastructure and Transport (or his delegate) and the head of the department of civil protection Presidency of the Council of Ministers (or his delegate), e) in Article 1, paragraph 7, the Commissioner delegated to the necessary support in the activities of its direct jurisdiction, is empowered to award up to a maximum of twenty fixed-term contracts or to project collaboration, based on selection criteria of the fiduciary character; f) Article 1, paragraph 8, that the Deputy Commissioner shall, by its decision, the fees to be paid to the person referred to in Article 1, paragraph 7;
Article 21, paragraph 1, of Act June 18, 2009, No 69, containing "provisions for economic development, simplification, competitiveness as well as for the civil trial," government has no obligation to publish on their websites, in which the principles of transparency and good governance, curriculum vitae, the data on the salaries of managers and institutional contacts (as well as information about the rates of absence and presence of personnel of each executive office) -:
who the implementing bodies appointed by the Commissioner for the emergency prisons on the basis of Article 1, paragraph 4, of the order of March 19, 2010 President of the Council of Ministers;
what is the compensation of persons appointed by the Commissioner actuators
delegate for the emergency prisons on the basis of that Article 1, paragraph 4, and what are the job profiles and tasks performed by each of them;
many fixed-term contracts and / or project has entered the Commissioner delegated to the prisons on the basis of emergency 'Article 1, paragraph 7, of the order;
how much, with reference to these fixed-term contracts and / or project, the fee determined for each subject by the Commissioner for the emergency prisons on the basis of Article 1 , paragraph 8, of the order;
if it intends to enter on the official website of the Ministry of Justice, based on the principles of transparency and good governance in the legge n. 69 del 2009, i dati curriculari e quelli relativi alla retribuzione dei soggetti attuatori nominati dal commissario delegato per l'emergenza carceri sulla base dell'articolo 1, comma 4, di cui all'ordinanza 19 marzo 2010 del Presidente del Consiglio dei ministri;
se non intenda inserire sul sito ufficiale del Ministero della giustizia, sulla base dei principi di trasparenza e di buona amministrazione sanciti dalla legge n. 69 del 2009, i dati curriculari e quelli relativi alla retribuzione dei soggetti con i quali il commissario delegato per l'emergenza carceri ha stipulato contratti a tempo determinato ovvero di collaborazione a progetto (ex articolo 1, comma 7, di cui all'ordinanza 19 marzo 2010 del Presidente del Consiglio dei Ministers).
